Heard learned counsel for the parties.

In this writ petition, the petitioner is claiming right of appointment on the post of Patwari on the ground that he has secured 204.99 marks out of 300 marks but appointment has been denied on illegal grounds and ignoring the merit of the petitioner.

While issuing notice to the respondents, an order was made by the Coordinate Bench of this court on 2.1.2014 whereby it was ordered that one post shall be kept vacant for the petitioner and it shall not be filled in without leave of this Court.

An application was filed by one Naresh Kumar for 2

impleading him as party respondent on the ground that he is more meritorious then the petitioner, therefore, that application was allowed and Naresh Kumar was impleaded as party. The respondent Naresh Kumar filed an application under Article 226 (3) of the Constitution of India stating therein that he has secured 207.78 marks but due to stay order granted by this Court, the respondents are not providing appointment even though applicant has secured more marks than the petitioner, therefore, the stay order passed by this Court may be vacated.
