BY THE COURT:
Having regard to the submissions made in this restoration application supported by the affidavit of the counsel, we are satisfied that there had not been an intentional default on the part of the appellant in carrying out the compliance of the peremptory order dated 23.09.2013. Having regard to the submissions made, the application is allowed. D.B. Income Tax Appeal No. 105/2012 is ordered to be restored to its number.
Further, having regard to the submissions made and in order to avoid unnecessary rotation of the matter, it is also considered appropriate and hence, the prayer for dispensing with filing of the certified copy of the order of the ITAT dated 27.07.2012 stands granted subject, of course, to all just exceptions.
The application seeking dispensing with filing of the certified copy in the appeal stands disposed of. The restored appeal (No. 105/2012) be listed for consideration alongwith D.B. Income Tax Appeal No. 104/2012.
