This criminal misc. bail application under Section 439 Cr.P.C. has been filed by the petitioner. The petitioner has been arrested in connection with the FIR No.246/2014 of Police Station, Mandor, District Jodhpur for the offence punishable under Section 392 IPC.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It is also contended that during the course of identification the complainant has failed to identify the petitioner. It is also contended that the offence for which the charge-sheet has been filed is triable by Magistrate and the petitioner is behind the bars since 27.03.2015.
