Mr Vikram Singh Rajpurohit, Public Prosecutor. This criminal misc. bail application under Section 439 Cr.P.C. has been filed by the petitioner. The petitioner has been arrested in connection with FIR No.26/2015 of Police Station, Chakhu, District Jodhpur Rural for the offences punishable under Sections 341, 323, 395 and 120-B IPC.
Learned counsel for the petitioner has submitted that the petitioner has not been named in the FIR and he has been made accused solely on the ground that he is the registered owner of the vehicle involved in the commission of crime. The complainant has named Sriram S/o Hadmana Ram, Pemaram Bishnoi S/o Padiyal and Vikas S/o Baburam Bishnoi as the accused in the FIR and the case of the petitioner is distinguishable from the persons named in the FIR. Learned Public Prosecutor has opposed the bail application.
