1. This special appeal is directed against the order passed by learned Single Judge, by which, he has confirmed the interim order dated 21.01.2014 till the disposal of the writ petition.
2. The appellants have entered in a tripartite agreement with the borrower and the Bank to purchase the mortgaged property under Rule 8 of the Security Interest (Enforcement) Rules, 2002. They have, thereafter, approached the Debts Recovery Tribunal, Jaipur ('the Tribunal') for execution of the document of sale of the property, by which, loan amount of the Bank and the interest will be discharged.

Before the Tribunal could pass any order in the matter, the writ petition giving rise to this special appeal was filed by one Shri Rajendra Baheti, who had entered into an agreement of sale to purchase the property two years ago, which was mortgaged with the Bank from Shri Lokesh Agarwal, Director, M/s Kwality Conduit Pvt. Ltd., Jodhpur. Shri Rajendra Baheti had also entered into the same agreement with Shri Mahendra Agarwal, Director, M/s Kwality Conduit Pvt. Ltd., Jodhpur agreeing to sell the land.
