Heard learned counsel for the petitioner. In this writ petition, petitioner is seeking following directions :-
"i) The order dated 15.01.2013 (Anenxure P-2) passed by the respondent no.2 whereby the prosecution sanction has been sanctioned to prosecute the petitioner may kindly be quashed and set aside.
(ii) The order dated 25.02.13 (Annexure P- 3) passed by the respondent No.3 may kindly be quashed and set aside."
The main contention of learned counsel for the petitioner is that assessment of the property has wrongly been made by the competent authority while issuing prosecution sanction dated 15.01.2013, therefore, the prosecution sanction issued by the Executive Engineer is not sustainable in law. Further learned counsel for the petitioner submits that the impugned order is bad because a false case has been registered 2
