HON'BLE MR. JUSTICE DINESH MAHESHWARI HON'BLE MR. JUSTICE ARUN BHANSALI

Mr. Ravindra Singh for Dr. P.S. Bhati, for the appellant. <><><>

This appeal is reported to be time-barred by 12 days. Having regard to the submissions made, while ignoring delay, we have examined the merits of the case.

It is noticed that by way of the writ petition leading to this appeal, the appellant, who had been a candidate in the recruitment process for the post of Physical Training Instructor Grade-II and Grade-III, made the prayer for award of bonus marks for some of the alleged ambiguous questions. The learned Single Judge found that the matter involved disputed questions of fact, which too were being raised after completion of the selection process. The learned Single Judge, therefore, expressed disinclination to exercise writ jurisdiction. However, and even while dismissing the writ petition, the learned Single Judge extended liberty to the appellant to raise his objection before the respondents by way of filing representation
